disgusting. now, people during the day will see how busy the clairemont neighborhood is. fire trucks and police cars everywhere, trying to secure the damaged homes and help impact the homeowners, also their cleaning crews, and hem handing out business cards, promising to take care of repairs. homeowners are being warned to watch out. imagine losing your home and spending hours to scour through the ashes, only to find there is truly nothing left. no mementos, no documentation that your family ever lived in that spot? justin white took precautions to protect himself from hazardous materials. the contractor's state license board says there are people out in preying on homeowners in their most vulnerable time. >> right now we're hearing of

people out there, but we're not running into them yet. >> reporter: they tell homeowners to be aware, and ask to see every contractor's license. it proves the contractor has experience and has gone through a criminal background check. >> a lot of times people don't have licenses, they know they will never be able to passion. you have people convicted of fraud out here doing this work. >> everything you can imagine just burned. >> servpro is one of the comp y companies hired by pg&e to go through the houses and remove dangerous chemicals that could cause respiratory problems. >> right here where we are, we're in the lowest location, everything is going to run this way if it rains. >> reporter: now, city planning and building officials have come

up with a rough estimate of $38 million in property damage caused by this explosion that is just a rough estimate. some say just looking at those homeowners sifting through what used to be their belongings in their homes, how do you put a price on that? live in san bruno, traci grant nbc bay area news. >> thank you. more examples of victimizing the victims. you see it after every disaster. now san bruno police tell us they've arrested four people trying to get free food and other help by posing as victims of the explosion. police say bianti taylor tried to cash in tuesday. they have not been charged, but two other women were arrested for trying to pass themselves off as victims and get aide as well. heightened concerns about the smell of gas prompted the evacuation as two bay area schools today.

portollo elementary is located less than a mile from the explosion. firefighters and pg&e workers were called out. it turned out there wasn't a leak, but parents praised the school's quick actions. >> just the principal smelled a little bit of gas, and he's very smart to take the precaution and evacuate the school. especially where we're in the area where the gas pipe explosion occurred. so they evacuated the school, everything was done excellent. they left us a message, our children are safe. and i'm proud to be a portollo mom. libby, did you enjoy your bus ride? >> yeah. >> better safe than sorry. despite the all clear signal, classes were cancelled as you saw. later in the same day, san francisco elementary was also evacuated because of the smell of gas too. it also was a false alarm. fire officials say they're getting a lot more calls after last week's explosion. >> in less than an hour now, a vigil is set to begin for a

mother and daughter killed in the explosion. 44-year-old jacqueline greg and 13-year-old janessa greg are among the four people killed in the explosion that happened a week ago tonight. family and friends will gather at saint cecilia church for a vigil. a vigil for 20-year-old jessic morales who was also killed in the fire will be held tomorrow. we have an update on three patients. one is critical, two are in fair condition now. a fourth patient was released after treatment. well, 78 days and still no budget in sight. the legislative budget deadlock now poised to be the longest in california history. and yet legislative leaders say they are making progress. president darryl steinberg said today that democrats and republicans are about $2 billion a way from a deal.

some lawmakers suggested borrowing from the state's largest pension fund to help balance the books. >> it's frustrating, it's maddening, and it's embarrassing. the people of california, i think, have every right to be unhappy about it. >> in order to do that, they would have to approve any loan to the state, and the organization has already relesioned a letter yesterday blasting that proposal. larry geursten our analyst is here. why aren't we more patient about setting this record tomorrow? >> the ones who are most affected are the ones with the least influence. the students in k through 12 not getting their grants. all these people really don't have a lot of clout, once you start talking about people who are really affected like state workers, taking away their salaries, giving them iou's, then you'll see an awful lot of

noise. right now, it's the people who have been least affected who are talking about it. >> in large part, the state is still paying its bills. come next month, that's going to change significantly. when everybody starts feeling a little more pain, maybe then we'll get more information. >> caught a break this month. the controller told us, we're actually about $253 million came in more than they thought. yes, it will tide them over for one more month. all we're doing is pushing off. >> we just heard from the senate president that these negotiators are $2 billion. that might come as news to people in the state of california who really get the sense that nothing is happening up in sacramento. what's your take on this? are they getting close? >> if the $2 billion is coming from purrs, they're only 68% funded itself. how do you borrow from something that is incomplete. there's something to the story we don't know. it may be there, but we need to see more before we can say anything. >> apparently there's a lot to the story.

the democrats say they want to raise taxes and cut some things. the republicans say we're not raising any taxes, somewhere in there there had to be some significant compromise that we haven't heard about. >> the story is the same story we've heard for the last eight weeks. eight weeks ago governor schwarzenegger said we're just a couple billion dollars apart. well, we still are and it's eight weeks later. >> governor schwarzenegger is saying, i am not going to sinai bill that does not give me significant budget reform. and let's face it, we need budget reform or this is going to happen year after year after year. >> he has tacked on a set of requirements that will be very difficult to meet. he wants to have a great fund existing, so that when there is a shortage. there will be money out there. there is no fund. he wants to change the taxation. you don't just do that overnight. what the governor wantses are major changes, will be hard to believe that those changes can take place in the next couple

whittier is in los angeles county, it's southeast of los angeles city proper. so far no one has been hurt, but some homes are being threatened by this fire. if they pull out a little bit, you'll be able to see a little more. wittier is east of the 605 in los angeles. it looks it appears to be a grass fire, can you see the firefighters working under there. some homes are being threatened. no one's hurt, we're going to keep a close eye on this and we'll let you know if anything changes. pot use in the u.s. is on the rise. what it means for prop 19, the initiative, to legalize it. we talked to both sides today. northern california home sales take another hit, but there might be some optimistic news between the lines. and some live pictures from at&t park, the dodgers take on the giants right here in less than an hour. and the giantses are just a half

a ship on its way into the bay struck a whale and dragged it into the port of oakland. the coast guard believes the whale was dead when it was hit, because there are shark bites on the carcass. marine officials will have to figure out how to get the whale off the ship. a bay area mother is still hoping her son is alive, weeks after he vanished near his home in mexico. 47-year-old lane gilbert, a wealthy real estate developer disappeared nearly three weeks ago. today we're learning his car was found just hours after he was

seen. the mexican police have not detained the man carrying gilbert's i.d. as a suspect. there are many who believe their police force is picking on them booze of their race. nbc bay area's garvin thomas has more on that report, if true, shows a widening gap between a community and its police force. >> the relationship between latinos and the sjdp has been a rocky one to say the least. police arresting latinos for being drunk in public at a rate much higher than any other in the city. now pac has put out a survey on the police force. mostly latinos took the survey during church services. in it, 65% say they know someone who has been stopped by police for what they believe was no cause.

60% say they have had a car impounded. and 65% say san jose police work with immigration officials, though the san jose police chief says that is definitely not true. >> it's not something that the police department by themselves can solve, in terms of a communication problem. the san jose pd has bent over backwards to put out policies on immigration, we constantly have an influx of individuals. >> the chief will be stepping down at the end of next month, he hasn't seen the methodology of the survey, he's not sure how accurate it is. while he doesn't believe his officers are racially profiling, if the community believes it, that's something that needs to be addressed by whoever follows him, of course p.m. live in the newsroom, garvin thomas, nbc bay area news. >> thank you. concord police shot and wounded a robbery suspect earlier today, after he brandished a gun at him. it was a realistic looking toy. before dawn, an officer spotted

the man near claytonoad and ash bury drive and recognized him as a robbery suspect. investigators say when the officers tried to detain him, he lifted his shirt to show he carried what looked like a gun. the man pointed the fake gun at officers who fired several times. the suspect is hospitalized in critical but stable condition. we all know the country's economy is struggling. did you know there's still strength in the tech industry? nbc bay area's business and tech reporter scott bud man is here with another success story. we need these. >> we keep getting them. this one coming from oracle, famous for its swash buckling ceo has been putting up impressive numbers. the company with new president mark hurd very optimistic about its future, oracle shares moving higher in after hours trading.

not expecting much rainfall, but once again it's going to bring us unseasonably early showers here from the north bay to the south bay. 6:00 a.m., temperatures in the upper 50s here for the south bay, by 11:00 a.m., the sun breaks out of the clouds, we're looking at 68 degrees. let's take a look here at the temperature profiles for 6:00 a.m. friday. low 60s in the south bay, and upper 50s in the north bay. we'll bring you into 11:00 a.m., and temperatures do not warm that much, we'll stay in the 60s for most of the bay area. let's get a look at any traveling delays, we did have some wild and severe weather moving throughout the northeast this afternoon. in fact a potential tornado in and around new york city with this line of storms as the front passed through. also some extremely gusty winds, that will keep the airports hinned in boston, new york and washington for the next couple hours, if you're traveling there, watch out for major delays. back here at home, we're going to time line these showers heading toward the bay area for your weekend coming up in the

marijuana mirrors a changing attitude. >> when we ask questions about young people's perception of risk of drugs, they don't see drugs as risky. >> some blame medical marijuana. dr. howard samuels says scores of his clients have become addicts as a result of medical marijuana. >> which is some of the most powerful toxic, marijuana out there. these are kids that are 17, 18, 19, 20 years old that are addicted to it, smoke it all day, all they do is walk into these shops and get whatever they want. it is a joke. >> reporter: today's report may end up playing a role on the ballot. it would be a tax source for local governments and would save costs on law enforcement here and in mexico. >> we're going to put those drug cartels out of business.

>> law enforcement and the treatment community argue there will be far greater cost to society. and today's increase in drug use will be a fraction of what can be expected in the future. >> if that proposition passes, we better start funding a lot of treatment programs. >> pot isn't the only drug gaining popularity. 9% of people over the age of 12 used drugs last year. ecstasy use up 37%. and meth use up 60%. cocaine abuse continues to decline, with the use of the drug down 32% from its peak in 2006. there is sobering news about the state of the national poverty rate. one in seven people is living in poverty now, the highest level in 16 years. last year was the third year in a row the poverty rate climbed. rising from 13.2 to 14.3%. that adds up to more than 43 million people. poverty is defined as an income

of $10 now, or less for a single person. $22,000 or less for a family of four. on capitol hill, both parties are holding to their positions when it comes to the expiration of bush era tax cuts. democrats want to raise taxes on the nation's highest wage earners while adopting across the board cuts for people who are not in that category. the tax cuts are the next big fight. >> tax cuts at the high end have not produced any jobs, they've only decreased the deficit. >> republicans in the house and senate are united, that this is not the time to increase taxes on anyone in america. >> the president is also pushing a new economic plan, the $30 billion small business plan to open up credit. and democrats say help create half a million jobs. yahoo undergoing a major face lift to help it move up in the dot com world. the company plans to make yahoo cool again. the coming attractions include

upgrades to its free internet service. starting this fall, people will be able to post updates to their twitter accounts from yahoo's e-mail. the inbox is also supposed to run twice as fast. tech stocks pulled the markets higher. the dow gained 22 points, the nasdaq up 1. hewlett-packard, nextel are just some of the stocks that jumped higher today. economists are less worried about another round of mass layoffs. jobless claims subject it is less likely new layoffs could set off a double dip recession. silicon valley is famous for its technology. this week a little extra creativity is being added to the mix. nbc bay area's business and tech reporter scott bud man takes us to 01. >> reporter: a video game, a

the work to create a pair of tunnels at devil's slide is nearing a major milestone. the project is set for completion in 2012. in the meantime, crews are digging toward the end. >> reporter: workers toil in darkness, it's here caltran's engineer ivan ramirez spends his days. >> they call them miners moles after all. >> reporter: workers cutaway at the mountain, creating two 240 foot long tunnels. >> they can be moist, muddy.

you really have to love this type of work to be in here every day. and we certainly do. >> reporter: ramirez and his crews broke ground on the tunnels three years ago. now, there is nearly a light at the end. >> right here we're about 100 feet, 125 feet away from breaking ground on the other side. >> crews expect to punch through the mountain on october 1st. it's a big step in the project, which will circumvent traffic around the notorious devil's slide. >> this is huge. breaking ground, punching through and opening the traffic. this is the second major milestone. >> once crews pierce the mountain, it will take two more years to finish the tunnel walls and the roadways. >> right now, we're pouring concrete for that segment of the tunnel. that's going to be the final project. >> it means many more dark days ahead, with the looming light of progress pushing them on ward.

>> pretty impressive feat. >> it is. it will make a huge difference too. >> on highway one, you watch, where are they, where are they? jeff ranieri. >> we're tracking the forecast, a lot of fog tonight. the most fog we've seen in a while at the giants game. wait until you see our sky camera here in a second. our inning by inning forecast, temperatures in the upper 50s, and then by 10:00 p.m. temperatures going down a built. it's going to stay breezy and foggy throughout the entire game tonight. sky cameras, we transition this into oakland looking toward san francisco. the fog building up to 2,000 feet offshore. winds 10 to 20 miles per hour at the coastline. that will keep the fog machine going tonight. we had some heat today for those of you in the east bay, walnut creek, livermore, upper 70s, low 80s. a few upper 70s in the south bay, and still above average for

parts of the north bay. with mid-70s around san rafael, and just outside of napa. temperatures dropping with that impressive bank of fog offshore. 70 in san mateo. already dropping to the low 70s here in san jose. a nice dropoff there in livermore as well. tonight the fog stays put. mid-50s by tomorrow morning, by friday, our system we're watching is offshore, that will bring us showers for the weekend, but the time line's been pushed back a little bit here from what we were seeing yesterday in the forecast models. radar's dry right now, we'll zoom out. we have been contending with cloud cover off to the west into the north. it's going to stay there over the next 24 to 36 hours. that's remnants of a different system. our system for the weekend is out here, tapping into a decent amount of moisture, the cold front, center of low pressure. it's going to lift off to the north as we head off to the next couple days. we'll see the bottom edge of this push across the bay area.

6:00 a.m. friday, we are dry around the viewing area. the models had some rainfall this time yesterday, for the north bay on friday. now, once again everything has been pushed back. 6:00 a.m., only a slight chance of a shower in the extreme north bay. santa rosa, a slight chance of showers. it's really all about sunday at this point for those widespread scattered showers. for the north bay to the south bay, totals will stay low. not a big soaker, but still, it's out of character, and it's odd for this time of year to get a system moving in this rapidly across the bay area. east bay for tomorrow, 57 to start off with the low clouds by 11:00 a.m., sun comes back out, temperatures in the upper 60s. as for tomorrow, we'll see very comfortable start here in the south bay, upper 50s to 60. that also goes here for the peninsula for redwood city.

upper 70s in the south bay, we'll feel some of the summer warmth down here. 77 in livermore, throughout the peninsula, a mix of low to mid-70s. 75 in redwood city, 68 in san francisco. close to 70s still in oakland and temperatures inland will also be in the upper 70s to near 80s as we transition into the north bay. morning time on the weather channel on cable. and here is the seven-day forecast. we go a little bit more on the cooler side, inland. saturday and sunday with the system pushing over, best chance for everyone to get showers once again will be on sunday. and then wouldn't you know it, as we transition over to fall on wednesday. mother nature goes back up to 80. it's hard to keep track of what day it is around here. it hasn't been stable at all. is raj wearing a jacket? he needs one at the ballpark. >> if you're going to boo the
